Terms of Service

These Terms of Service (“Terms”) govern your use of Pubby, an instant web publishing platform operated by Relevate Consulting Pty Ltd ABN [pending] (“Relevate”, “we”, “us”, “our”), trading as Pubby. By accessing or using pubby.au or any related services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the service.

1. The Service

Pubby is an instant web publishing platform that enables users to publish HTML, static files, and web content online in seconds. The service provides hosted URLs, automatic SSL certificates, CDN delivery, and optional features including custom domains, analytics, version history, and API access.

We offer free and paid subscription plans. Feature availability varies by plan as described on our pricing page at pubby.au/pricing.

2. Account Creation and Termination

You may use certain features of Pubby without an account (anonymous publish). To access account-linked features such as a dashboard, persistent storage, custom domains, or team workspaces, you must create an account by providing a valid email address.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you believe your account has been compromised.

You may close your account at any time via your account settings. We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe you have violated these Terms, engaged in illegal activity, or your account poses a risk to the platform or other users. Termination does not entitle you to a refund of any prepaid fees.

3. Acceptable Use

You may use Pubby only for lawful purposes and in accordance with these Terms. You agree not to publish, upload, or transmit content that:

  • Is illegal under Australian law or the laws of the jurisdiction where you are located;
  • Constitutes, depicts, or facilitates child sexual abuse material (CSAM) — this is an absolute prohibition and will result in immediate account termination and reporting to the relevant authorities;
  • Contains malware, viruses, trojans, spyware, adware, or any other malicious code intended to harm users or systems;
  • Constitutes unsolicited commercial communication (spam), phishing, or social engineering attacks;
  • Infringes the intellectual property rights of any third party;
  • Constitutes harassment, threats, or hate speech targeting individuals or groups;
  • Violates any person’s privacy rights, including the unauthorised publication of personal information;
  • Is designed to deceive or mislead users in a harmful way (e.g. fraudulent banking pages);
  • Attempts to circumvent platform security, rate limits, or access controls.

We reserve the right to remove any content that violates these policies or that we determine, at our sole discretion, to be harmful to users, third parties, or the reputation of the platform.

4. Free Plan Limitations

The free plan is subject to the following limitations:

  • Page expiry: Pages published on the free plan are automatically deleted after 7 days from the date of publication. You will receive an email reminder before expiry if you have an account linked to the publish.
  • Storage: Total account storage is limited to 500MB across all published content.
  • Rate limits: API requests and publish actions are rate-limited on the free plan. Specific limits are documented at pubby.au/docs.
  • Subdomains: Free plan pages are hosted on pubby.au subdomains only. Custom domains are a paid feature.

We reserve the right to modify free plan limitations with reasonable notice. We will endeavour to provide at least 14 days notice of material changes via email or in-app notification.

5. Paid Plans and Billing

Paid plans are billed on a monthly or annual basis in Australian dollars (AUD). Payments are processed securely by Stripe. By providing your payment details, you authorise us to charge your nominated payment method for the applicable subscription fee.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time via your account billing settings. Upon cancellation, your subscription remains active until the end of the current paid period, after which your account reverts to the free plan.

Refund policy: Monthly subscriptions are non-refundable. If you cancel a monthly plan, you retain access until the end of the billing period. Annual subscriptions may be eligible for a pro-rata refund if cancelled within 14 days of the initial purchase or annual renewal date — contact us at [email protected] to request this. Refunds are issued at our discretion and are not available where there has been a material breach of these Terms.

Prices are quoted in AUD and are inclusive of any applicable GST. We reserve the right to change plan pricing with at least 30 days advance notice.

6. Content Ownership and Licence

You retain full ownership of all content you publish through Pubby. We do not claim ownership over your files, HTML, or any other content you upload.

By uploading content to Pubby, you grant Relevate Consulting Pty Ltd a non-exclusive, worldwide, royalty-free licence to store, process, cache, distribute, and display your content solely for the purpose of providing the service to you and your end users. This licence terminates when you delete the content or close your account, subject to any retention periods required by law.

You represent and warrant that you have all necessary rights to publish the content you upload, and that doing so does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

7. Content Takedowns and DMCA

We respect intellectual property rights and will respond to legitimate takedown requests in accordance with our obligations. If you believe content published on Pubby infringes your copyright, please send a notice to [email protected] with the following information:

  • Identification of the copyrighted work you claim has been infringed;
  • The URL of the infringing content on Pubby;
  • Your contact information;
  • A statement that you have a good-faith belief the use is not authorised;
  • A statement, under penalty of perjury, that the information is accurate and you are the rights owner or authorised to act on their behalf.

We reserve the right to remove or disable access to any content, at our sole discretion and without prior notice, where we determine the content violates these Terms, applicable law, or where we receive a credible report of abuse, illegal activity, or DMCA infringement.

8. Limitation of Liability

Pubby is a hosting and publishing platform. We host content provided by users but are not responsible for that content. We do not endorse, verify, or take responsibility for content published by users.

To the maximum extent permitted by Australian law, Relevate Consulting Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of the service, including but not limited to loss of data, loss of revenue, loss of business, or loss of goodwill.

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim, or AUD $100, whichever is greater. This limitation does not apply to liability that cannot be excluded under the Australian Consumer Law.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except to the extent such warranties cannot be excluded under the Australian Consumer Law.

9. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. Planned maintenance, unexpected outages, or infrastructure issues may cause temporary unavailability. We will endeavour to communicate planned maintenance with reasonable advance notice.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or by displaying a prominent notice on the site at least 14 days before the changes take effect. Your continued use of the service after that date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from or in connection with these Terms are subject to the exclusive jurisdiction of the courts of New South Wales.
